Remember: If you choose not to hire someone, under the FCRA you must provide a pre-adverse action notice giving the applicant an opportunity review the background check, then send a final adverse action notice. There are many jurisdictions across the country that have requirements in addition to the FCRA’s for pre-adverse and adverse action notices. Be sure you are aware of and following the laws.
